In case you are getting calls from the wonderful people at NCO Financial Systems. You should read some messages people have posted about this company. Apart from having to pay $1.5 million to settle Federal Trade Commission charges that it violated the Fair Credit Reporting Act (FCRA), there are also many many claims of state and federal violations of legislation like the Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA).

The company purchases old debt from people like your cellphone provider, hospitals and the government for pennies on the dollar and then tries to collect it. You may have even already paid the bill, like I had, but that is really a minor irrelevant point. The reality is, much if not most of this debt is so old noone has any obligation to repay any of it, least of all not to NCO. Many people have been harassed for debt belonging to neighbors, relatives, old residents of the same address, and co-workers. Don’t pay NCO a penny.

To halt their “contact”, send NCO a certified, return-receipt cease and desist letter (they throw away all faxes and non-certified letters). A sample letter might read (though, you must seek real legal advice, which I’m not):

This letter also verifies that I live at the address above, therefore, any further locator attempts would be a violation of the FDCPA.

NCO may or may not report your debt dispute with them on your credit report. It is important to make sure that if NCO puts anything on your credit report, all of the information is accurate, such as date of debt, last activity on account and the correct amount.   1. 215-441-3000–this is the number of the lady who called and said she was from Sprint. I called Sprint earlier that day to upgrade one of my phones on my Sprint account, because I get a $150 credit after two years. I guess she was trying to pull one over on me, because when I started to ask her a lot of questions, she hung up. Apparently, they have affiliates with Capital One, which also miraculously appeared as an account on my credit report-I have contacted the FTC and reported suspects-all individuals have harrassed me by attempting to block me from viewing my own accounts, etc. I also contacted all 3 credit reporting agencies, and I have had to call the Dekalb, Ga. authorities to report names of suspected local people, so when the FTC completes their investigation, they can compare notes with the local authorities, and these stalkers can be arrested–it’s one thing to invade someone’s privacy because of a loose nut in the box, but quite another to steal someone’s identity and use it as their own, even pretending to be married to the person. In fact, isn’t there a federeal law against that , making that person a felon when convicted?! You could say I will be quite the vindictive one, to say the least–somehow, these FOOLS have to learn a lesson in a federal prison for a few decades.

  2. I just got a call from 1-866-889-6745. retuned their call straight away and asked them who they were looking for, gave me a name of angel *****, advised them this is not me and that they need to remove the number from thier list as I’ve had it a week.
    Said they will remove me and I won’t receive anymore calls.
    We will see.

  3. Beat them at their own game. I call them several times a day and speak gibberish, call them names, make up stories and generally waste their time. It’s all gooks that work there for some reason, and they hate it when I tell them so. Today I told them that I was unable to make payment, and she insisted that I could do SOMETHING. I suggested that perhaps I could be a male prostitute and send NCO the money, but she thought that was “using profanity.” DUMB SLOPE!

    I called back and told the brainless amoeaba on the phone that I would contact the attorney general of PA, and hung up.
    I pay all my bills on time and do not have any outstanding debts. How they got my number I do not know.

    I went to buy a house in Nashville in May of 2008. I found the perfect home and applied for a home loan through CHASE. Come to find out that even though my credit is great I have a collection for $200 from an SBC home telephone line in Compton, CA. I have lived in California before but nowhere near Compton. It was up to me to clear this up before my closing date two weeks later or else I was not going to be approved for my home loan. I called NCO Financial and finally got through to a woman who was hell bent on not telling me how to fix this situation. When I asked to speak to a supervisor she put me on hold and the phone mysteriously disconnected. The second woman I spoke with said a SSN number that started with 298- and I corrected her that my SSN starts with a 296-. About the fourth time she did this I stopped her from talking and told her this was the problem, it’s not my SSN. She then paused a moment and than said, “oh, it is 296-xx-xxxx!” I told her that this was as shady as can be and I wanted to speak to a supervisor. After being on hold for a long time a woman picked up and and explained that she was a supervisor. I asked her how I could resolve my problem and the only thing I could understand of what she was saying was to prove that I didn’t live in Compton, CA or pay the money. I don’t know exactly how to prove that you didn’t live somewhere, I think that’s impossible so I had to do the opposite and prove where I did live. Anyway, the rest of our conversation was useless due to the fact that this woman was speaking ebonics with a heavy accent, I’m not sure if it was a joke that they were playing but I kept trying to tell her that if she’s speaking English I have no idea what she is saying. What a professional company this NCO Financial is turning out to be!

    With no success being able to reach anyone at NCO Financial that could help me and who wouldn’t place me on hold without the phone magically hanging up(a big game they like to play), I focused on proving every place I lived for my entire life. This way, even if no one at NCO Financial would help at least CHASE hopefully could pull their heads out and apply some common sense to this situation and realize that this isn’t my debt. If I was going to ruin my 750+ credit it would not be over 200 fucking dollars!!! Anyway, I did just that, I now have documentation for ever place I have ever lived and the dates as well. I forwarded this information to CHASE and called NCO Financial to try and reach someone that could give me a fax number so that I can get this information to the proper people. After several failed attempts and being transferred from department to department and being jerked around a woman was finally able to help me. She started off the conversation and immediately said 298-xx-xxxx. I couldn’t believe it, ever since the first time I corrected one of their representatives all the people have been saying 296-xx-xxxx. I knew this was no coincidence and immediately stopped her. She asked me to spell my name which is not a common one, in fact there are only 11 of my last name and they are all family in Ohio, I’m the only one to have ever left Ohio bearing this last name. She said that the SSN’s do not match up and the first name is miss-spelled. It was obviously fraud and she said they would remove it from my credit within thirty days. That didn’t help my current situation with CHASE so she said they would fax me a letter by the end of the business day. I waited and low and behold no fax. I called the next morning and got in contact with a supervisor named Dave King. He assured me that he would put a rush on it but that it takes them time to type up this intricate letter and they are working as diligently as possible. I waited and finally just before the end of the second day the fax came through. It was a pidly two-liner that contradicted itself as follows: “Please be assured that our records do not reflect your having owed on the above account number, nor have we furnished your information to any credit reporting agencies. Despite this, to the extent your information is appearing on any report with any credit bureau which we do business, we have made a request to delete our listing of the above referenced account from your credit profile.” What the fuck is that? Amazing. These people are the scum of the earth. They are the dog shit on the bottom of my shoe and I hope this happens to their asses at least once in their pathetic lives. They make Lawyers, tax assessors and used car salesmen seem like saints. The sad thing is I bet half of the people who jerked me around this whole time are barely above minimum wage with real credit problems of their own, none of them sounded like they had a descent education or clue as to what they were doing. I also wonder how many people, especially the elderly that would have gave in and paid just because they feel like they have to or don’t know any better. What a group of crooks!!!

  12. NCO has recently begun calling my mother’s house, she lives in a different state and I have not lived there for years. Is this legal? I don’t even know how they got that number, I do owe debt but accrued it long after I moved away from my mother’s. I tried calling the number but it just says all reps are busy and goes to a voicemail but the mailbox is full.

  13. NCO called me today, and I have been out of town for the past 2 weeks and see on my caller ID that they have been calling me almost every day while I was gone. I answered today, and they told me about an unpaid balence that I owe on my Discover card… hmm that’s funny, I do not own, nor have I ever owned a Discover card. He tried to verify my SS# and address… woah buddy, I am not giving you any of my information. I simply yelled at him that I don’t have a Discover card and hung up. Sounds like a scam to get my info!

  15. I have a new phone on my fiance’s phone plan, and He and I do not have any debt or way of procuring debt. I have gotten numerous calls from 866-473-9021. They have identified themselves every time but only identified who they were calling for once, and it was so low and quickly spoken that it was impossible to understand but sounded like it may have been “Sharon.” I have gotten the option to press that I am not who they are looking for once, and sat for 5 minutes listening to dead air before I got fed up with waiting and hung up.

    Have all called my parents house 24 times (collectively) within the last 4 days. They have not identified themselves since the first two or three calls that came through. They are always hang-ups or the morons going “hello. hello. hello.”(we have the generic “leave a message after the beep” answering machine message, so they cant mistake it for someone answering) This is ridiculous

Are you saying all any one has to do is run up a debt and then not pay for it for years then eventually it will be too old to collect? In response to gruntled 26 apr 08, to let you know and to also everyone else on here, i have recently gave up my position at nco, i currently went on sick leave due to a broken foot and they started hasselling me about getting a doctors note to prove my claim and what followed after that was a letter sent to me by ups which appeared like a collections notice saying that i didn’t call them back concerning the matter and so on and so on, i was shocked that they wld treat even a employee like that, and thanks for your comment about me seeming like genuine person, and that is my personality, i am a very caring person my all means, And for those who are having problems with them, ignore the calls and if they don’t stop after that or if they don’t stop after you telling them to remove, i also think that alternative measures should be taken to make them stop, the centre i worked at was a canadian one that delt with strickly the u.s the department that i was in, but head office is located in the u.s, i don’t blame anyone on here for their anger towards this, if it was me going through it i wld be the same way, and calling on a weekend, whats with that, i thought it was a mon to fri thing!

  18. I have received calls from NCO. They are vultures! The first number they left for me to call was 1-800-860-4200 but didn’t say who they were. So I called back and was yelled at by the rep. Today, I got a call from the same rep but the number didn’t show up as “unavailable” it actually showed up 937-427-7300. If I actually had the debt and had received some paperwork on it, I would have paid it but then they would probably still be harassing me!

  24. They keep calling me (only once a day) asking for some person who owns the Paw Paw patch and that this is the number listed for the business. I have never answered any of the calls because they either call from “unknown” or a 416 number which is in Canada. Anyway, I have read other sites that say that they will accuse you of “hiding” the person if you say they have the wrong number. They haven’t asked for any debt, but they wont stop calling!! Would it be worse if I answered?

  25. in case you don’t already know it. these people will make you crazy. be assertive with them. call them out on their game. If you’re reading here, then you’ve probably already been researching them and you’ve read about how they work. Insist on working with your original creditor. ask for copies of signed contracts and itemized statements. send them cease and desist letters. it will at very least force them to do something other than harass you for a few minutes. and….if you either never answer their calls or refuse to work with them, you’ll notice that a company with a different name will start to call you. It’s not usually the same company. They sell your debt to yet another company for even less than they paid for it to start with and the cycle starts all over. Generally speaking…if you agree to pay even 10% of your bill…they got their money back…but before you do…i’d ask for a written contract that states the amount you’ve agreed to pay and the terms of the agreement…i.e…this will be marked paid in full with all credit bureaus…etc., etc. And NEVER send money without the agreement and when you do send the money…keep a copy of the payment. I suggest you refuse any pmt option besides a simple money order that you mail to them. They’ll try to tellyou that you’ve agreed to mail payments in the past and you didn’t do it and they won’t accept mail payments and you have to give them a checking account number or a credit card number or wire them money via WESTERN UNION. DON’T DO IT! They’ll charge the whole amount to your accounts and Western Union fees are just more money you have to spend. SAY NO! You can usually buy a money order at any bank for a dollar or less. Whatever you do…send them a letter insisting they stop calling you. I can deal with mail statements. Generally…unsecured debts like credit cards are never going to end up causing you to have your wages garnished. Student loans, back taxes, child support…yes…but collection agencies for unsecured debt…not likely.
    DON’T let them have the upper hand. Don’t give them any information if at all possible. Answer your home phone like a business…make up a business name if you must. Never give your name when you answer…just say…something like…Front Desk…or 1835 Pine, How can I help you? When they ask to speak to you…say…she’s not available may i take a message…(this can be a clincher right here)…they shouldn’t talk to you at all. Ask who they are…company name, address…purpose of call…their full name (expect a lie)…if they won’t give it…tell them no one there takes calls without knowing what they’re about. Just be as obnoxious as they are…they’ll pass you on to another company. And remember….they paid less than 10% of your balance for your debt…your original creditor charged it off and took their tax loss…you SHOULD refuse to work with any agency other than your original creditor!

  26. I received a call today from NCO about my AMEX business card. I am having a hard time financially right now and was 3 months behind on my AMEX. The person I spoke with as for the full balance in 30 days. There was no way I can pay that much. Then I was offered to pay off the balance in 6 months or just 10% of the balance. I told them the amount I could pay each month, and they refused to accept my payment. (She stated she wasn’t, but she did take it either.) She advised me to take out a loan with my bank or pay off the card with another credit card. I cannot do either. One thing I did not get, I was told if I paid the amount I could afford, that would not pay the interest rate of 34% that AMEX would start charging after 30 days in collection. She told me that AMEX would make a lot of money off of me. I called AMEX and they are not longer servicing the account, NCO is. So, what the? Is this grounds for suing. I should have taped the dang call.

  27. found this site as i was on hold and soo glad i did. Was going to give them hell regardless as they had been calling my cell for months, i finally rang them back - turned out (after the first guy hung up on me) they were looking for the wrong person and had a “wrong number”. When I have a wrong number I apologise and refrain from calling that number again. Time will tell if they actually “remove my number”.
    Advice to anyone - ask who they are, what their cell/home/parents number, ssn, date of birth etc is…see how obliging they will be.
    I will be contacting the PA county prosecution to further strengthen their harrassment suit.
    To the employee of this “company” i’m surprised you feel even good enough to show your filthy post on here, worse still trying to defend this company, are you in training to be a defense attorney for peadophiles and rapists?   28. 1. When the Vermin call your cell…just put your phone on “contacts only” and anybody with a number not on your list goes straight to VM…and if it is a machine calling, it usually will not record…
    2. If you must talk to them: Tell them all future contact must be done by mail. Send them this in writing(certified..bla bla).
    3. Call the original creditor and work out ANYTHING! They will work it in this toilet economy! and screw the Vermin!

They NEVER leave a message on my machine and when I DO pick up (which I am going to stop doing), all I get is a some bulls*** recorded message telling me to ‘please hold’. I have NEVER even heard of this company before. I have had to start screening my calls to avoid them.

    Isn’t this kind of thing harassment?? I just want them to leave me alone. I live in CALIFORNIA and they once called us at 7:30 AM (well it was 7:30 here in California). Thats absurd! It was a Saturday too! Get a life people!

In response to “LD:” I have never heard of NCO until they started calling me a few weeks ago (I too am grateful for this website, I sent a cease communication letter two days ago based on information obtained on this site). I did not receive any type of letter or other communication from them before they began calling me and I have received no other types of communication from them since they began calling me several times a day.

  31. In response to Christine and her situation: 1) you do not have to talk to NCO and I would recommend that you stop answering your phone when they call and DO NOT give them a single penny! If you owe the money, call the company you owe the money to, explain the situation to them, and tell them that you would like to work out a payment plan with them directly. Make sure you tell them that you will not be working with the debt collection agency but, only with them and that any payment you make will be to them (the original creditor) and to no one else. I guarantee you that the original creditor will be MORE THAN willing to work with you and to take any payment play you offer to them. I would call the orginal creditor, say “I can pay you this amount of money every week or month where do you want me to send the money.” Don’t even ask them what they want you to pay, just tell them what you can afford and then follow thru. DO NOT tell them you can afford a certain amount and will be making payments at a certain time of the week or month if you can’t. Only make a commitment to what you can actually afford to do. Even if it’s only $10 a month, that’s better than nothing and they will take it, trust me. Plus, if you end up having to go to court, the judge will see that you have made an effort and, if the creditor didn’t take it, that’s their problem. 2) Now, on to NCO, legally, they are not allowed to threaten to “send the case to the county” or threaten you in any way whatsoever if they don’t intend to follow thru. That means that they can NOT threaten to sue you or to “send your account up” (whatever that means) just to get you to be scared and pay them something. It’s illegal for them to do that. I would send them a cease letter (the wording of it is on this website). If they continue to call you, speak to an attorney and sue them. HEAR THIS: what they are doing to you is illegal (the yelling and threatening), you CAN make them stop and they may end up owing you money, if you follow up and sue them.   32. I just spent a hour reading the mort recent posts. NCO has been calling us for weeks, this is the first time I seen an address for them, thanks much. In many states telephone conracts ( payment agreements) are not binding, has any one recived anything in writing from NCO before or after contact?

  33. One more piece of advice….go to the 3 credit reporting agencies & put a BLOCK on your report. No one can see any of your information without YOUR approval or request.

    Yeah, right. I know I don’t owe the debt and the original company is sending me a letter stating that there is zero balance! Don’t act like we (all) don’t pay our bills! I read the report from the PA Atty General on your company. You’re the collections equivalent of a heroin addict. You scrape the bottom for anything you can get and you’d sell your mother’s soul for the almighty dollar!

    To those being harassed: First, do as many other posts mention. Send the stop letters & such. If you DO owe the debt, contact the original creditor immediately. Swallow your pride & tell them what’s going on. I had to do this myself a few years ago. Called Capital One & First Union. Together I owed them about 4500 bucks. One had a higher interest rate than the other so each month they both got money, although the one with higher int. got more. They were BOTH more than happy to cut out the collector & work directly with me.

    What you have to remember is that you are NOT the only person out there that owes money & these banks want to get as much of their money back as they can. Many will even drop any new interest charges & possibly drop some of the old non-payment fees & such. Ask them! All they can say is no, but they know that “something” from a thousand-plus people every month beats “nothing” at all!

    Call them asap…they will work with you!

    DO NOT give these garden slugs ONE PENNY!!! You legally don’t have to if you pay the original creditor!

    There is a lot that you can do to fight NCO. If you need legal help, I recommend Lexington Law to stop the phone calls, letters and remove NCO from your credit reports. You can also check to see if NCO is posting negative credit report info on you.

  37. I just recieved 3 bills from NCO. I felt something was wrong the minute I opened these bills and after finding this site I can concluded that me feeling were right. Can anyone suggest how to dispute this legally. Where should I turn for legal advice?

  40. They kept on calling me several times an hour every hour a couple of months back, from different numbers. They never leave messages and when they do, it’s some automated message telling me to call them back with a reference number or some such rot. I’m on the Do Not Call list and have no debts, so I don’t understand why they harass me so. After a couple of weeks of quiet, they’ve started calling me again, this time from this number: 866-576-1447. I’m sick of it!

    I got a call at 8:10AM this Saturday that woke me from a dead sound sleep.
    It was NCO - They hung up when I answered.
    They called me back at 10:26AM telling me that my JPMorgan Chase acct. was in danger of being sent to “the next stage” and if I didnt show a committment to pay, the acct was going to be “sent on” to my county on Monday. (I’m assuming means courthouse) - HELP!
    The amount is up to $3800.00 now - $1800 of which is late and interest fees that I did not spend.

    I told them that I didnt live in that county anymore. The girl I spoke to was very nice and I told her that yes, I hadn’t paid on this acct in about a year due to needing major surgery and being out of work, and a very bad financial year last year. She asked me what I made now and where I worked and what I did - and how much I paid for rent and for my car. (those were the only questions she asked).
    She sympathized with my situation and offered me a settlement agreement of $2122.00 - which I dont have. She then offered me a three month payment of 836.00 for three months to pay it off ($2507.00) - which is almost half my monthly paycheck or a 12 mo. payment of 321.51.
    She said the first payment must be paid in April - and it is now April 26th!
    I explained to her that my wedding is in two weeks and that I could not make a first payment until May 15th (I didnt think this was unreasonable - is it?) They were trying to “do me the favor” of it going to the county.

    Then a man gets on the phone telling me because it is so urgent on a time constraint, we need your immediate committment. I asked him why they were calling me on April 26th to ask me for a payment by the end of April - (Just a few more days) and that was unrealistic, and had they called me sooner, I may have had a chance to do more about it by the end of April. He then started YELLING at me - saying that he had been calling me since April 2nd!
    I told him that I had never received any messages from him prior and he said that is because my machine would not let him leave a message and that I was a grown woman, and should have known I was in trouble for this debt.
    I said back to him that there was no reason to yell, and that my home machine took messages just fine and that I was sorry if he had a machine doing the calling, but I would not have had any idea who they were just by seeing an 877 number on my caller ID - and that I would have hoped that someone would have just spoken and waited for the beep for me to call them (No-one ever has).
    He continued YELLING at me saying I was twisting the situation and then I said that he needed to calm down. He then started demanding my new address and I said I would not give it to him unless he calmed down and I asked to speak back to the girl I had been dealing with that was a lot calmer.
    He said NO, I dont intend on being nice and I am hanging up in 5 seconds and telling them to send it on if you dont cooperate - and then I hung up on him.
    I was not going to be abused like that !!

    I am scared though because Capital One got a judgement on me and then threatened to garnish my wages if I didnt pay it. So I had to take care of it at that point. The courthouse was not even in my state so I couldnt even show!
    Can they do that? Garnish wages?

    Any advice on what to do? - is appreciated.

You can find a better employer. Good Luck! NCO seems to prefer to pay fines when caught, rather than really change their practices. Paying fines for harassing people is just a cost of doing thier business and keeping thier execs and stockholders in profits and dividends.

  46. Oh my lord people. Don’t pay these people any money!!
    First, if you pay them even one penny it restarts the clock on the statute of limitations. There are other things that can restart the clock too so check with a lawyer or research it to make sure you don’t accidentally do something that would restart it. Once the statute of limitations has run out (like four years or something) then they can’t sue you.

    Second, paying them anything just opens the door for them trying to get more. It’s like those scams that take advantage of the elderly. Once you have paid once then you will be hounded even harder across the board.

    Calling these people scum is insulting to scum.

    They will lie, cheat, intimidate and harrass. They will call your neighbors, the neighbors of your family in other states. They will call at work and leave messages with your co-workers.

    Ignore them. Then ignore them some more. Eventually after a period of time with absolutely no success they will just sell your debt to some other scum for one cent on the dollar.

    Don’t for a second think that if you try to be nice and talk to them they will stop being scum. If you talk to them they will just get more information out of you and then use that information against you. For example suppose you say “gee i can’t make a payment now because my father is dying of cancer and i’m spending my days at his bedside” they might sympathetically say “oh, i’m so sorry, where is he hospitalized”. If you tell them then don’t be surprised when the nurse tells your father that a collection company is looking for you about “a case”.

    You think i’m joking??? I have a video of them harrassing me at my father’s funeral (CBS wan’t to do a show?).

    The only saving grace here is that they are so nasty and so unreasonable that they have invariably harrassed the wrong person. In all of the calls they’ve made i’m sure they have probably gone a little too far with someone ‘connected’ and if they haven’t yet they probably will someday.

    We can at least smile knowing that they probably have to check under their beds before they go to sleep at night.

  47. If they are calling your cell phone, it’s pretty simple - you add them to your phone book and select “SILENT” for their ringer! Of course they will call with another number so you’ll have to add as may numbers as it takes to maintain your sanity.

    Not sure if you all have ever heard of Dave Ramsey? You can listen to his shows online… http://www.daveramsey.com He handles a lot of callers on his show that are being harassed.

    As for the NCO collector thats posting on here… Do you think that calling people over and over is going to make them suddenly be able to pull money out of their ass to give to you? Get a real job!

I had just called them back and was placed on hold for 10 minutes at which point I hung up, and won’t be calling them back. I will persue your recommendations. Comment: is this type of operation a symptom of an economic system on the verge of collapse? A system where no one produces anything that anyone else wants to buy and therefore we become parasites feeding on those few who do? Where is the government to protect us from the piece of desease that runs this type of operation? What about a person who is not firm of mind who receives such a call from these preditors and inocently sends them money? Also is there not a possiblity that the credit reporting agency are profiting from peoples fears? Another way to make money by setting up computers and sitting back as the money rolls in.   52. The best bet is to play by the rules and then when they call after you’re contested the debt keep track of it. Record all conversations (ideally electronically) and the forward them to the attorney general and 60 minutes etc on cd. And when they continue to attempt contact after being told that the debt is contested or a with a cease and desist notice just keep track of this and sue them (either with an attorney or just follow up in small claims court in your homw state where the fee is low and just hope for a judgment if they don’t respond). Remember that the people who own this company have mansions, boats, planes and laugh at all the suckers they collect on for pennies on the dollar. Yet they likely have criminal connections themselves and have been cited for multiple violations by the US government … which is ironic when you look at some of the soapbox rantings posted here by some of their supposed current and past employees. It’s really just a game to make more money and remember that the top brass of these collection agencies are living the lifestyle that most of us only dream of.

    was left by a Ms Nelly (really hard to hear). I am absolutely sure I have no debt as I pay off all my bills. Since the message didn’t include a recipient’s name, I kinda guest it’s a scam. First thing I am going to do is obtain my credit report (from all 3 credit bureaus-they are required to give you a free copy once every year). Then I am going to call these bastards and give them hell. FYI, I believe they’ve just lost a case against them brought by PA. If you want to file a complaint, DA website from PA would be a good start. You can even do it online.

I have also had a numerous amount of other 888, 866, and miscellaneous numbers calling me the past few weeks and not leave messages. I finally was home when one of these people, Matthew Watts, called and he was very rude. Neither my wife, nor I have any debt as I just pulled our credit reports to verify. The guy was a jerk on the phone and said he would keep calling as it was “his right”.

  83. These vultures got their beaks into some student loans of mine, and while it’s still early in the game, I wanted to share their antics so far:

    1) They called the corporate office of the company I work for and got the number for the location at which I work. They called, looking for me, while I wasn’t working and misrepresented themselves to the girl currently working by saying there was a “problem with my payroll.”

    2) As a result, I unthinkingly called them back and ended up talking to the woman who originally called. She wasn’t nasty but mentioned wage garnishment, something, going by the following guidelines, they cannot do:

    3) She passed me onto some joker who played the whole sleazy, buddy-buddy used-car-salesman bit until I told him that I couldn’t consent to a payment over the phone (especially not one that was three times what they’d get if they could even legally garnish my wages), and he rattled on about how he wasn’t “playing games” and that’s the absolute lowest and that they could garnish my wages and steal my tax return and if I paid it for so long it’d be taken off my credit report (yeah, need that in writing, bud). I finally hung up on him, called the original woman back and told her they were not to call my workplace anymore (I had too higher members of management there as witnesses).

    I was put in touch with a consolidation company by a lady at the college I attended, so I’ll be working to try to get everything shifted into the other company’s hands. Meanwhile, I’ll be sending a cease and desist order to NCO, after contacting the attorney general.

My Sirius subscription expired in January, the service terminated, but a few days ago I get a collection notice from NCO on behalf of Sirius for $32.83. I’ve learned from the past just to ignore these people, but they continue to call every day. They will not take you to court; they rely on intimidation tactics to get suckers to pay them. Simply ignore NCO.

  114. We all know, as a whole we have little use or concern for a bill collector. Particularly if they’re trying to collect on a debt you paid off last year.
    Truth is, they’re probably making the calls, hating every one of them, when they get called a name and compared to the sloppy, warm cow dung in the field, etc. Hell of it is they have to make a living the same as we do and believe me, if I had to settle for a collections job, I’d be buried under hard times. There would not be one other job available, even that of a street sweeper.

    A “payment of intent” reaffirms the debt and restarts the statute of limitations in every state I know of. This is a trick, you send them even a dollar on a $5000 debt and the statute of limitations is reset and they can take you to court for the full amount.

  118. Understand that NCO has purchased these debts, they are +not+ calling on behalf of anyone but themselves. If the debt is beyond the statute of limitations they have paid maybe 1 or 2 cents on the dollar, maybe less. The original lender is out of the picture, AMEX (or who ever) will not get 1 dime of what you pay. The money goes to NCO.

    They usually do not have the paperwork on the debt, only the amount and last payment date. They cannot produce legal proof that the debt is real. It’s a bluff, these people could make a fortune at poker.

    Paying them can actually hurt your credit. After 7.5 years an unpaid debt disappears from your credit report. If you pay them a reduced amount this is a new entry on your credit report and will remain there for another 7.5 years. It will hurt when you try to get a mortgage or other credit.

    DO NOT TALK TO THEM OVER THE PHONE. THEY WANT TO TRICK YOU INTO REAFFIRMING THE DEBT AND RESETTING THE STATUTE OF LIMITATIONS. IT’S A TRAP. That’s why they try to avoid paper. Don’t fall for it. All correspondence should be done in writing. Do not provide personal information to them over the phone, wait for the letter and don’t add to what they already have.

  119. Can NCO be sued for giving someone a nervous breakdown? And I mean that with 100% seriousness.

    They have my cellular phone number and sometimes their auto-dialer calls me 2-3 AN HOUR, and up to 15-20 times a day from various numbers. It starts right on 8:00 pacific time, and lasts into the evening up until 9:00 pacific time.

    The constant and relentless calls are nerve racking. I’m already being treated for a nervous condition and the repeated and nonstop hammering from them is seriously exasperating my condition.

    My cell phone was meant for emergencies only as well, and to have it firing off every 15-30 minutes from NCO makes me furious.

  122. I started receiving calls from 1-800-273-6816 in early Feb 08. I thought they were telemarketers until one day I answered and it was a recorded message. I called the number back with my “reference number”, and come to find out I had a “debt” from a credit card company. The unfortunate thing is that I never even knew that I had this debt. I paid that CC company almost $8K to pay off the balance last June. Unfortunately, that was not the whole amount - i was about $90 short. I NEVER received another bill, and six months later, that $90 became about $350 and the bank charged it off at the end of the year - hence the collection agency. I’m not a person with a history of not paying bills. Nonetheless, the guy was very rude to me and I didn’t appreciate that at all. A loan officer told me once that it is worse for your credit to pay off a collection agency that it is to have a charge off. I don’t know if that is true or not.

  123. Hey, wdg1021 why don’t you just answer the phone and make arrangemts to pay your bill? Do people know that you don’t have to pay balance in full today that you can make arrangements to settle the debt over a 1-6 months? let them transfer you to other people it’s called getting a talk off. negotiate the amount and term MAKE OFFERS be ready to settle for between 45-85% of the balance. the older the bill the bigger discount on the settlement. my suggestion when calling is to get a prepaid phone with voice mail on it and give that number to the collector. never turn it on. just let them call it and leave a message. other wise call from work or a payphone since it is a toll free number. keep negotiating over time don’t get fooled by whats called urgency. collectors want to collect your bill this month. you have to realize that you do need to make some kind of payment this month make a payment of intent if you cant pay the first part of the settlement say you are going to settle for $500 every month for 3 months, but you make this arrangment too late in the month. offer to make a payment of intent or a payment to show good faith offer $100. try to send the good faith payment western union quick collect or money gram. the collector will try to get you to put a check on file tell the collector you need to see your arrangment in writing and have it faxed to you. also when you are done paying it off have a paid in full or settled in full letter faxed and sent to you. get everything in writing. follow my advice and you’ll save money and not have a bad experience with the collector. be polite on the phone they are just trying to antagonize you in to just giving up and paying thinking their is no other way out. don’t induldge it if they are really rude hang up call back untill you get a different collector or ask for a manager. keeping talking to different people till you get what you want. don’t be affraid to hang up and call back. keep working at it. they will eventually meet your number.

  124. if the statute of limitations has run out on the debt a debt collection agency can still try to collect it, they just cant sue you for it anymore in civil court. you always have the MORAL obligation to pay a debt, just not always a legal one. YOU SHOULD PAY YOUR BILLS!!!!

  125. if you think the debt is not yours ask to verify by social security number. i am a collector for nco and we have your ssn thats why we have your credit report. if the debt is not yours don’t worry about it tell them you have the wrong number and to stop calling also send a cease and desist letter certified mail. i am sorry to all the wrong numbers that get called i don’t want to be calling a wrong number but poeple change their number fast and directories move slower. it is the debtor’s responsibility to keep their creditor updated with phone number and address changes but they don’t so blame them. if we had the right numbers to call wrong numbers wouldn’t happen. The fact of the matter is that most debtors don’t want to be found. they don’t want to pay their bill or they would call us. there are MILLIONS and MILLIONS of these bad debts. why don’t they get paid? if they were owed to you personally would you want them to be paid?

  127. Information for all your readers….I have been investigating this company (NCO)along with several others, including Asset Acceptance for a family member of mine that is getting harrassed constantly by phone calls. This is the information that I have found:

    The statute requires that the debt collector obtain verification of the debt and mail it to the consumer. Because one of the principal purposes of this is to help consumers who have been misidentified by the debt collector or who dispute the amount of the debt, it is important that the verification of the identity of the consumer and the amount of the debt be obtained directly from the creditor. Mere itemization of what the debt collector already has does not accomplish this purpose. As stated above, the statute requires the debt collector, not the creditor, to mail the verification to the consumer.
    Under the FDCPA, you are allowed to validate this debt, and the creditor (in this case, the collection agency) must show you proof that you owe the debt to the collection agency (not to the original creditor.) Plus, they must show proof positive that you owe them this debt. It’s not enough to send you a computer-generated printout of the debt. Nor can they ask you to pay for digging up records of your debt:
    o Proof that the collection company owns the debt/or has been assigned the debt,
    o Complete payment history, starting with the original creditor, and
    o Copy of the original signed loan agreement or credit card application
    So, if a creditor can’t verify a debt:
    • They are not allowed to collect the debt,
    • They are not allowed to contact you about the debt, and
    • They are also not allowed to report it under the Fair Credit Reporting Act (FCRA). Doing so is a violation of the FCRA, and the FCRA states that you can sue for $1,000 in damages for any violation of the Act.
    The Debt Validation Strategy
    It might be helpful to look at our illustration of the process before you get started. You might also want to read this, sort of our own “validation” of the process given here.
    1 Send a letter requesting validation to the collection agency.
    2. If you don’t know the address of the collection agency, it is easy to look up on the internet.
    3. Dispute the collection with the credit bureaus.
    4. Wait 30 days to hear back from the collection agency. Most likely they will not respond or they will respond saying that they received your letter. Only a letter which includes:
    o Proof that the collection company owns the debt/or has been assigned the debt,
    o Complete payment history, starting with the original creditor, and
    o Copy of the original signed loan agreement or credit card application
    is satisfactory.
    5. If they haven’t sent you satisfactory proof, send a copy of your receipt for your registered mail, a copy of the first letter you sent and a statement that they have not complied with the FDCPA and are now in violation of the Act. Tell them they need to immediately remove the collection listing from your credit report or you are going to file a lawsuit because they are in violation of the FDCPA, section 809 (b).
    6. Wait 15-20 days to hear back after this second letter to the collection agency. They will either remove it or not respond.
    7. If they do provide a contract with a signature from the original creditor showing that you owe the debt, there is one more thing you can try: see if they are legally licensed to collect the debt in your state.
    If you believe that they are not licensed, and licensing is required in your state, write them another letter and tell them they are in violation of your state’s collection laws and are subject to prosecution and fines. Cite your state’s fines and procedures in the letter. This is a last ditch effort, but has worked in some cases.
    8. Typically, your work will stop here, as most legitimately legal collection agencies will bow down to your demands and send you a letter agreeing to remove the listing. Now all you have to do is send a copy of the letter to the CRAs.

    If the collection agency did not agree to remove the listing, then you need to continue to the next steps.
    9. File a lawsuit in small claims court against the collection agency on the basis of violating the FDCPA.

    11. In the meantime, in a parallel effort with your lawsuit against the collection agency:
    12. If the collection comes back as “verified” from the credit bureaus, you now have proof of further collection activity from the collection agency. (The assumption is that the credit bureau contacted the collection agency to verify the debt.) Since the collection agency did not validate the debt, further collection activity is a violation of the FDCPA.
    13. Contact the credit bureaus, and tell them that the creditors did not verify the debts under the FDCPA, and send copies of your proof. Request the method of verification, which is your right under the FCRA. It is crucial to contact the credit bureaus before filing a lawsuit. Make sure you state that the collection agency did not respond to your request for debt validation.
    14. You can try sending them a letter to see if they will budge. They may tell you that the request needs to come from the creditor. This is baloney. If they can’t give you reasonable information on how they verified the information and the collection agency has provided you none, you can conclude there was no reasonable investigation performed. They are teetering on the edge of “willful non-compliance” under the FCRA. Tell them so.
    15. File a suit in small claims, state or federal court. The basis of the lawsuit should be that the credit bureaus could not provide a satisfactory method of verification, or did not conduct a reasonable investigation.

    Notify the bureaus that you are suing them. The credit bureaus will call the creditors and find out that there is a question about whether the debt is legitimate. They should delete it immediately.

  129. I work for NCO and its an awesome job. I enjoy a high level of income and have good job security. Integrity and respect are two values extremly important to me. I believe i am a pleasure to deal with on the phone and I will bend over backwards to help borrowers that want to reach a compromise.

    I realize wrong numbers get called it happened to me i have a very common name and a collection agency kept calling me. I contacted them and it didn’t stopped. I just called my cell phone provider explained the situation and the rep on the phone issued me a new number for FREE. I know its an inconvience, but collection agencies are crutial to the economy.

    If bad debts didn’t get collected on then more and more people would default and cause all of our intrest rates to rise. I realize there are bad collectors that break the laws, but most don’t. There are lots of people on this board that feel they’ve been wronged. If you truly feel that way and have a legal basis then sue. Many lawyers will take on a good case to sue a collection agency for FREE. My point is there are solutions for everyone out there that may take a little time and committment but are the right thing to do. Most of the the the right the to do is not the easiest. Change your number. Sue. Pay your bill. Send a cease and desist letter. Take action and DO the RIGHT thing.

    Not sure which FDCPA you are referring to (maybe some fictitious one you were trained on), but the actual federal law in no way, anywhere, permits a collector to call all day, everyday, if there is no answer. In fact, repeated telephone calls are explicit violations under the law. There is no law, anywhere, requiring anyone to answer any call from anyone at any time, much less a collection agency. Nor is anyone obligated to speak to, or say word one, to a collection agency. By calling all day, everyday, a collector is violating MULTIPLE federal laws (and probably the debtor’s home state laws), primarily 15 USC sec. 1692 (Fair Debt Collection Practices Act-FDCPA). I have personally experienced this, having received over 500 calls from NCO over a 4 week period. That’s right: 500! Unfortunately for NCO, I have the records to prove it. Not only have I reported them to my state atty. general, but the PA atty. general, FTC, and several of the trade associations they claim to be members of on their website (ncogroup.com). [All of the associations have a complaint process against members. It’s funny too, they all have “codes of ethics” members must adhere to. Yeah, right. They’re debt collection associations. I’ll hold my breath to see what happens.] I am also suing them in civil court. Perhaps if enough other people do the same, something will happen. You can take them to small-claims and do it for cheap. Just know your rights and have ample evidence to back up your claims. KEEP RECORDS OF EVERYTHING!!! How this company continues to keep their doors open is utterly beyond me. If I or my company broke the law in our industry, we’d be shut down before we knew what hit us. Court records show that NCO has been sued over 1000 times, by everyone from individuals, to class actions, to the Commonwealth of PA, and the Federal Govt. They have injunctions against them from violating the FCRA (Fair Credit Reporting Act), and did settle federal charges for $1.50 million dollars for violating the FCRA. They also have a settlement agreement on record with The Commonwealth of PA obliging them to adhere to their obligations under FCRA and FDCPA. (Google it all). BY THE WAY: It is also a federal offense under 47 USC, sec. 227 (b)(1)(B) to initiate any call to any residence using a pre-recorded device to leave a message, and another federal offense under 47 USC, sec. 223 (a)(1)(D) and (E) to cause a telephone to ring repeatedly or to utilize telecommunication devices to place such calls (ie. telephone harassment). Obviously check with a competent attorney to validate any of this, I AM NOT GIVING LEGAL ADVICE. In short, “nco collector”, unfortunately you don’t know what you are talking about, and I hope you have since left the collection business, so that you can move on with your life and stop being subjected to abuse. If not, be aware that you can be named a direct party to civil action if any is brought against your company. I hope this all helps someone out there. There has to be a way to shut this abonimable company down, and I have decided to make it my mission to find out how!

  131. I have found that the best way to deal with these debt collectors is to send a validation letter. You can get an example at:

    Then, if they call without verifying the debt, you keep copies of all the call dates & times and, according to the FDCPA, they are liable for up to $1000 per call after they receive the letter. Send 2 copies, one regular and one certified, return receipt. That way you have a receipt of when they received it.

    Once again, if they fail to follow the request, there is a penalty for each call after the request is received by them.

    Unfortunately, you must usually answer the phone for their calls and verbally dispute the debt. That way, they need to send you a letter about the debt, if they haven’t already.

    I am not advocating not paying your debts, but sometimes it requires fighting for your rights against companies like this, ESPECIALLY if they have PURCHASED the debt from your original creditor. That happened to me - I was paying off my credit cards from college through a CCCS with payment arrangements through all of my cards. One bank sold the debt, even though payments were being made. It is now in litigation, even though the amount they are trying to collect is, according to my records, is incorrect. It is a time-consuming process, but can be worth it in the end if it ends.

    NCO, CRS, Asset Acceptance (now calling themselves AIS) have had major problems in the past and now collecting debts. AIS is even trying to collect a debt after ignoring a validation letter (they replied by asking for a SS# and tons of personal information, like looking it up by name, address and phone number weren’t enough).

    Well, that’s my 2 cents (all I can AFFORD to give with the litigation :-)

I called the 800 numbers and both times encountered the same extremely rude and unhelpful secretary/operator. Twice she transfered me to a recording while I was in mid-sentence asking them not to call me anymore, then I called from a phone that has caller-ID blocked, and nobody picked up at all, it went straight to the recording.

  133. My tenants call me to say that NCO is calling them about a bad debt. This debt was from a prior tenant who has long since moved. I’ve called NCO several times to tell them that the person they’re looking has moved and no longer resides at that adr./phone number. They assured me that they would take their debtor off their calling list. But they keep calling.
    What’s with these idiots?! How do I get them to stop harassing my tenants?

I know I don’t have any outstanding debt (I had a problem a few years ago that get paid off the beginning of ‘07 with a different credit company) and I haven’t gotten anything in the mail or anything specifically with my name on it, I’d love to just keep ignoring them but the phone calls are just getting ridiculous now. Does sending the cease and desist letter actually work? or am I going to actually have to eventually call these people back?

  137. I have been taunted by many NCO personel and it is a very nerve racking feeling, a sinking feeling everytime the phone rang. I tried to ignore it kinda like the “heartbeat under the floor in EdgarA Poe” they called me at work as well as 8am to 9pm. They recorded my voice everytime i spoke to them. I just received another call from a Mr.Frank. or people like David Spillman (NCO). It’s a fuckin nightmare. But then again I have been iresponsible for them hounding me. So i can this, They use a automated dialing system in the morning at 7am, then when they had their coffee i assume the get bigger balls and converse with you in a rude way. I can see it now, I new Yahoo at NCO is getting advise from a overweight , donut consuming piece of lard telling him you must talk down to these people and give them misguided information. Oh yeah they fly under RADAR on all of the conversation. That is why they monitor the calls they make ( low beeps in the back ) All in all if you can pay these fucks what they want the they will stop. They do make you feel like shit, so like cancer use the family as chemo and rid these mutations from your life. If you are worried about telling your spouse or family about this. don’t. Just tell them and getthe funds. They will NOT stop. and mailing a letter is only adding salt to the wound. you will have your day in court trust me it’s happening to me next week.

  140. NCO contacted us at an address re: a debt that is not mine. I have not contacted NCO since they don’t have my name or phone number, only my address. I never owed this debt to begin with, and I don’t want my name associated with someone else’s debt. I have filed complaints with the state atty gen. Anyone else have a similar experience? What should one do if they don’t owe the debt to begin with? I don’t want my credit tarnished b/c of someone else’s old debt.

  141. I have read most if not all of the complaints and am shocked that people are so cruel and foul mouthed on the internet as well as the phones. I understand alot of your frustrations but most collectors are not rude and are geniunely tryng to help people get out of collections. Collections is not a easy thing to do but it is a job. We have bills too and it isn’t personal. So the name calling and racial slurs isn’t necessary. People do call wrong numbers the company is not tryng to make you pay someone else’s debt, it is just a wrong number and as far as getting 3 and 4 calls a day..yes that is ridiculous and we dont agree with it but per fdcpa a call can be placed everyday all day if there is no answer. If u are getting calls from nco and you tell them it is a wrong number most likely the rep has removed it and another dept has a debt which explains the different numbers….no nco dept has more than one number.
